Abstract

The rapid development of internet technology has significantly impacted various aspects of life, particularly in the field of commerce, which has increasingly shifted toward digital transactions or e-commerce. While e-commerce offers advantages in terms of efficiency and accessibility, it also brings new legal challenges, especially concerning violations of intellectual property rights in the form of trademark infringement. This research adopts a normative juridical approach with a descriptive-analytical method to examine the effectiveness of legal protection for trademark use in digital-based transactions. The research data were obtained through literature studies, covering relevant statutory regulations and legal theories. The findings indicate that trademark violations in e-commerce still frequently occur. Legal protection for registered trademarks is essential to prevent unauthorized misuse by irresponsible parties. Law enforcement efforts may be pursued through litigation or non-litigation avenues, in both criminal and civil frameworks.
